Terms of Use
for srp-ua.ch
These Terms of Use govern access to and use of the website and web platform srp-ua.ch (the "Platform"). How SRP handles personal data is described separately in the Privacy Policy. By registering an account or using the Platform you accept these Terms.
1. Operator and scope
1.1 The Platform is operated by the association Support and Recovery Platform (SRP), Basel, Switzerland, an association under Art. 60 ff. of the Swiss Civil Code ("SRP", "we", "us"). Contact: info@srp-ua.ch.
1.2 These Terms apply to every visit to the Platform and to every registered account. Separate written agreements (for example a donation agreement between a Donor and a Recipient, or a membership agreement with SRP) take precedence for the matters they regulate.
2. Purpose of the Platform
2.1 SRP is a non-profit association. The Platform is an information, matching and coordination tool that helps Swiss donors offer serviceable equipment, vehicles, infrastructure and other operational resources, and helps public institutions, non-profit organisations and communal service providers in Ukraine request them for civilian recovery purposes.
2.2 The Platform is not a marketplace for sale. Items are offered free of charge. SRP does not buy, sell, own, store, insure or transport items unless it expressly agrees to do so in writing in an individual case.
2.3 Information on the Platform is not a binding offer, a guarantee of support, a financing commitment, or legal, tax, customs or technical advice.
3. Definitions
| Term | Meaning |
|---|---|
| Donor | An individual or an organisation that offers items through the Platform. |
| Recipient | A registered organisation or institution in Ukraine that requests items through the Platform. |
| Administrator | Authorised SRP staff or mandated persons who review accounts, items and requests. |
| Item | Any equipment, vehicle, facility or other resource listed by a Donor. |
| Request | A request by a Recipient for one or more Items, submitted through the request cart. |
4. Registration and approval
4.1 Some functions are available only with an account. Donors register with their e-mail address, name and password, declare whether they act as an individual or for an organisation, and provide the organisation and warehouse details required by the Platform. Recipients register their organisation and contact details.
4.2 You must be at least 18 years old and, if you register for an organisation, authorised to act and to bind that organisation. Information you provide must be accurate, complete and kept up to date.
4.3 E-mail addresses are verified by a time-limited link or code. New accounts remain inactive until an Administrator has reviewed and approved them. Review may include contacting you by phone or e-mail and checks required by law (see section 9).
4.4 SRP may refuse, suspend or delete an account at its discretion and is not obliged to give reasons. There is no entitlement to an account or to any matching, support, transport or financing.
5. Account security
5.1 Keep your credentials and verification codes confidential. You are responsible for all activity under your account unless you notified SRP without delay of unauthorised use.
5.2 Notify info@srp-ua.ch immediately if you suspect misuse of your account.
6. Rules for Donors
6.1 You may list only Items that you own or are entitled to donate, that are free of third-party rights, and that are lawful to hand over and export.
6.2 Descriptions, images, quantities, condition, packaging and availability must be truthful and complete, including known defects. Keep listings current and hide or delete Items that are no longer available.
6.3 The following may not be listed: weapons, ammunition and other military goods; goods that are subject to export licensing or that SRP cannot clear as non-dual-use; hazardous or regulated substances without the required documentation; stolen, counterfeit or unlawfully obtained goods; and any goods whose transfer would breach Swiss law, sanctions or the law of the destination country.
6.4 Every new Item is reviewed by an Administrator (plausibility and dual-use check) before it becomes searchable. Approval is not a guarantee of legality, suitability or transportability.
6.5 Unless agreed otherwise in writing, the Donor remains responsible for the Item until handover, including tax, customs and export formalities that fall on the owner. SRP does not confirm tax deductibility.
7. Rules for Recipients
7.1 Only registered public bodies, non-profit organisations and businesses providing communal services in Ukraine may request Items.
7.2 Items must be used for the stated civilian, humanitarian or communal recovery purpose. They must not be sold, exchanged, rented out for profit, transferred to unrelated third parties, or used for military purposes.
7.3 Requests must reflect a genuine need. You must cooperate with the documentation SRP or the Donor reasonably requires, including donation reporting and confirmation of receipt and use.
7.4 No payment, gift or other advantage may be offered or requested in connection with an Item, a Request or an approval. Offending accounts will be blocked and, where required, reported.
8. Requests, matching and handover
8.1 A Recipient submits a Request through the request cart. An Administrator reviews it and may approve, adjust, defer or decline it. SRP decides in line with its statutory purpose, its resources and the legal and practical possibilities of the parties.
8.2 SRP acts only as intermediary and coordinator. The donation itself is agreed between Donor and Recipient. Transport, customs clearance, insurance, import formalities and commissioning are arranged separately and only on the basis of separate agreements.
8.3 SRP gives no warranty as to availability, condition, suitability, legal permissibility, transportability, customs eligibility, economic viability or usability of any Item or need reported by users. Items are donated "as is" unless the parties agree otherwise in writing.
9. Export control, sanctions and compliance
9.1 SRP and its users must comply with Swiss law, in particular export-control and sanctions legislation (Goods Control Act and Embargo Act) and the applicable law of the destination country.
9.2 SRP may screen users, Items and Requests, request additional information or documents, delay or refuse any transaction, and disclose relevant information to competent authorities (for example the State Secretariat for Economic Affairs, customs and law-enforcement authorities) where the law requires or permits.
9.3 You confirm that you are not the subject of sanctions relevant to the Platform and that you will not use the Platform to circumvent them.
10. Use of the website
10.1 Use the Platform lawfully, for its intended purpose and with respect for third-party rights.
10.2 Prohibited in particular: misuse of forms or contact addresses; unlawful, misleading or abusive content; unauthorised access to systems, data or accounts; disrupting operations; automated reading, scraping or systematic copying of content without SRP's prior written approval unless the law permits it; and any use that harms SRP's purpose, the security of the Platform or the rights of third parties.
10.3 You are responsible for the accuracy, completeness and lawfulness of everything you submit.
11. Content you submit
11.1 You confirm that you may submit the content you upload (texts, images, documents, technical data, project descriptions) and that it infringes no third-party rights.
11.2 You grant SRP a non-exclusive, royalty-free right to store, structure, translate, display on the Platform, forward to relevant partners and otherwise use that content for the purposes of the Platform: review, matching, coordination, communication and reporting. Personal data is handled as described in the Privacy Policy.
11.3 Submit confidential or sensitive information only where necessary and where you are authorised to share it. E-mail and web forms carry residual security risks; agree a suitable channel with SRP in advance for particularly sensitive material.
12. Website content, availability and external links
12.1 SRP takes care to keep content accurate and current but cannot guarantee accuracy, completeness, availability or freedom from errors. Content and functions may be changed or removed at any time.
12.2 SRP may restrict or interrupt access for maintenance, security reasons, technical faults, suspected misuse or further development. Uninterrupted availability is not guaranteed.
12.3 Links to third-party sites are provided for convenience. The respective provider is solely responsible for its content. A link is not an endorsement.
13. Intellectual property
13.1 Texts, logos, names, graphics, images, concepts, documents and layout on the Platform are protected by copyright, trademark or other law, unless stated otherwise. Use of the Platform confers no rights to them.
13.2 Reproduction, editing, distribution or other use beyond statutory limits requires prior consent from SRP or the rights holder. Accurate, non-misleading, non-commercial references to SRP and srp-ua.ch are permitted.
14. Suspension and termination
14.1 You may close your account at any time by writing to info@srp-ua.ch. SRP may suspend or close an account at any time in case of breach of these Terms, legal or compliance concerns, misuse, prolonged inactivity or discontinuation of the Platform.
14.2 Closing an account does not affect agreements already concluded between Donors and Recipients. Data is retained or deleted as described in the Privacy Policy.
15. Liability
15.1 To the extent permitted by law, SRP excludes liability for direct, indirect and consequential damages arising from the use or non-use of the Platform, technical disruption, data loss, inaccurate information, external links, security incidents, the conduct of other users, or the condition, transport or use of Items.
15.2 Liability for unlawful intent or gross negligence, liability for personal injury, and any other liability that cannot be excluded under mandatory law remain unaffected.
15.3 To the extent permitted by law, you are liable to SRP for damage and third-party claims caused by your breach of these Terms or by unlawful or inaccurate content you submitted.
16. Data protection
16.1 Personal data is processed in accordance with the Privacy Policy, which is a separate document and is not part of these Terms.
17. Changes
17.1 SRP may amend these Terms at any time. The version published on the Platform applies. Registered users will be informed of significant changes by e-mail or on the Platform. If you continue to use the Platform after the change takes effect, you accept the amended Terms; if you do not agree, close your account.
18. Reporting concerns
18.1 Report suspected misuse, unlawful listings or security issues to info@srp-ua.ch. SRP will review reports in good time and may take action under section 14.
19. Final provisions, governing law and jurisdiction
19.1 If a provision is or becomes invalid, the remaining provisions stay in force. The parties replace the invalid provision with a valid one that comes closest to its purpose.
19.2 These Terms and the use of the Platform are governed exclusively by Swiss substantive law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
19.3 The place of jurisdiction is Basel-Stadt, Switzerland, unless mandatory law (in particular consumer protection) provides otherwise.
